Terms and conditions
These Terms and Conditions ("Terms") govern the use of the Lumapack website and the supply of products by Lumapack ("we", "us", "our"). By placing an order or using our website, you agree to these Terms.
About Lumapack
Lumapack supplies food-grade packaging products, including custom-branded packaging, to coffee shops, restaurants, cafes, and food service businesses within the United Kingdom.
Orders and contract formation
All orders are subject to acceptance by Lumapack.
A legally binding contract is formed only once we issue written order confirmation (email or invoice).
We reserve the right to refuse or cancel orders due to pricing errors, artwork issues, stock availability, or compliance concerns.
Product information
Product images, descriptions, dimensions, and capacities are for guidance only.
Minor variations in colour, material, thickness, finish, or print alignment may occur and are not considered defects.
Products must be used strictly for their intended purpose and in accordance with food safety requirements.
Custom branding and artwork
By submitting artwork, logos, or designs, you confirm that you own the rights or have permission to use them.
Lumapack accepts no liability for copyright, trademark, or intellectual property infringements arising from customer-supplied artwork.
Colour reproduction may vary due to printing processes; exact colour matching is not guaranteed.
Once artwork has been approved and production has started, custom-branded products cannot be amended, cancelled, or refunded.
Proof approval is the customer's responsibility. Errors approved in proofs are not grounds for refund or replacement.
Pricing and payment
All prices are in GBP and exclusive of VAT unless stated otherwise.
Delivery charges are quoted separately.
Full payment is required before production or dispatch unless agreed otherwise in writing.
We reserve the right to suspend or cancel orders due to non-payment.
Delivery
Delivery dates are estimates only and not guaranteed.
Risk of loss or damage passes to the customer upon delivery.
Any shortages, damages, or visible defects must be reported within 48 hours of delivery.
Returns and claims
Custom-branded and printed packaging is non-returnable and non-refundable, except where faulty or not supplied in accordance with the agreed specification.
Claims must be submitted in writing within 3 days of delivery and include photographic evidence where applicable.
We reserve the right to inspect returned goods before approving any replacement or refund.
Food safety and compliance
Where stated, products comply with applicable UK food-contact regulations at the time of manufacture.
The customer is responsible for ensuring products are suitable for their specific food use, storage, and operating conditions.
Lumapack is not liable for contamination, misuse, improper storage, or post-delivery handling.
Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
Subject to clause 10.1, Lumapack shall not be liable for indirect or consequential losses, including loss of profit, revenue, or business.
Our total liability shall not exceed the value of the goods supplied under the relevant order.
Intellectual property
All website content, branding, designs, and materials remain the intellectual property of Lumapack unless otherwise agreed in writing.
Privacy and data protection
We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy for full details.
13. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including supply chain disruption, transport delays, industrial action, or government restrictions.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
